The petitioner is languishing in custody for the offence punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

According to F.I.R., Bank had sanctioned loan in favour of different consumers and the consumers had pledged NSC certificates in their name. According to the Bank, informant personally visited the petitioner in the Post Office and got NSC certificates verified and after oral certification by the petitioner that the certificates are genuine, loan was sanctioned. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.12190 of 2020(2) dt.29-02-2020 2/2 Bank adopted method completely against the official Rules. Verification should have been sought for in writing and response should also be received in writing. Just to save skin, false case was lodged.

Finding substance in the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kotwali P.S. Case No. 118 of 2015, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
