JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Begusarai Muffasil P.S. Case No. 377 of 2017, disclosing offences under Sections 498A and 363 of IPC and Section 3⁄4 of Dowry Prohibition Act.

Allegation against the petitioner is that on demand of dowry, tortured and harassed the opposite party no.2. On appearance of the opposite party no. 2, the matter was referred to the District Mediation & Reconciliation Center, Begusarai, vide order dated 30.07.2019, but due to non-appearance of the petitioner, mediation could not succeed. Submission of learned counsel for the petitioner is that he is still ready to keep her with dignity and care and due to some reason, he could not appear on the last date. Heard learned APP as well as learned counsel for the

Patna High Court CR. MISC. No.8776 of 2019(7) dt.24-09-2019 2/2 opposite party no.2, who has submitted that she is also ready to live with him, if she is allowed to live with full dignity and care. Having heard both sides, considering the stand of the parties, let the petitioner, above named, surrender before the learned court below on 16.10.2019 and on that day, the opposite party no.2 shall also remain present in the Court. On appearance of both the parties and on filing of a petition by the petitioner that he is still ready to keep her with full dignity and care and take her from the Court itself, the petitioner shall be released on provisional bail for a period of six months.

During that period, both the parties shall appear before the learned court below in the third week of each month, so that the learned court below shall watch the conduct of both the parties and their marital relationship. Once being satisfied with the conduct of both the parties, especially, the conduct of the petitioner, the learned court below shall confirm the bail bonds of the petitioner, otherwise he is free to pass any other order or orders, which may be deem fit and proper, including the cancelling of bail bonds of the petitioner.

With the aforesaid observations, this application is disposed of.
