Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 341, 308, 323, 504, 506 of the Indian Penal Code.

As per prosecution case, it was co-accused Shakti Paswan who fired upon the informant's son.

Learned counsel for the petitioners submits that there is no specific overt act alleged against the petitioners. Similarly situated co-accused Durga Paswan has already been granted bail by the Co-ordinate Bench of this Court vide order dated 03.01.2023 passed in Cr. Misc. No.59367 of 2022. Petitioners claim clean antecedent.

No.9278 of 2023(2) dt.25-04-2023 2/2 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Gaya in connection with Khizersarai P.S. Case No. 304 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
