The petitioners seek bail in a case instituted for the offences under Sections 3 of the R.P.U.P. Act. The police has recovered two batteries from the bush but the petitioner has been made accused in the present case. The petitioners are in jail since 13.9.2015.
Having considered the facts and circumstances of the case, let petitioners, namely, Munna Kumar and Bishundeo Kumar alias Bisundeo Kumar, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Patna in connection with R.P.F.
Patna High Court Cr.Misc. No.49215 of 2015 (2) dt.04-11-2015 Mokama Case No.6 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioners (ii) If the petitioners are found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioners.
