The petitioner seeks regular bail in connection with Dumra P.S. Case No. 527 of 2018 registered for the offence punishable under Sections 272, 273 and 414/34 of the Indian Penal Code and Sections 30(A), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 450 litres of Nelapi Soufi liquor from two Sumo vehicles and the petitioner was apprehended while he was sitting in one of the said vehicle. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent. It is

Patna High Court Cr.Misc. No.8594 of 2019(2) dt.13-02-2019 2/2 stated in paragraph no. 8 of the petition that the petitioner has got no concern with the vehicle or with the illicit liquor seized by the Police. Lastly, it is submitted that the petitioner is languishing in custody since 13.12.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Dumra P.S. Case No. 527 of 2018.
