====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 01-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Bibhutipur P.S. Case No. 373 of 2023 dated 18.09.2023 registered for the offence punishable under Section 392 of the I.P.C.
3. As per the prosecution case, the informant is a teacher in 'Diamond Coaching Academy', Shahpur, Bushwar, Bibhutipur and on 16.09.2023 after completing the coaching classes, he proceeded towards his house and reached near Keshari Klin, Khokhsaha then two persons stopped him and on the point of pistol, looted his 'Honda Shine Motorcycle' bearing Registration No. BR09AK 3630 and cash Rs. 900/- and fled
Patna High Court CR. MISC. No.15684 of 2025(3) dt.01-07-2025 2/3 away towards Khokhsaha. It is further alleged that some service books and official papers were also kept in the dickey.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the F.I.R. is lodged against unknown. It is further submitted that the name of the petitioner has surfaced in the present case during the course of investigation, on the basis of his self confession. No incriminating article has been recovered from the possession of the petitioner. The charge has already been framed in the present case. The petitioner has eleven (11) criminal antecedents and one case, he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 12.12.2023.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rosera, Samastipur or its available successor court in connection with Bibhutipur P.S. Case No. 373 of 2023 with
Patna High Court CR. MISC. No.15684 of 2025(3) dt.01-07-2025 3/3 further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
