Petitioner seeks bail in Lodipur P.S. Case No.20 of 2019 registered under Sections 354A, 354D, 504, 363 and 511 of the IPC and under Section 8 of the POCSO Act. The mother of the victim alleged that the petitioner used to stalk her daughter while she was going to school and on the date of occurrence the petitioner caught her daughter and tried to get her seated on his motorcycle but somehow the victim fled away to her house and narrated the entire story. Learned counsel for the petitioner submits that the petitioner is a co-villager of the informant. The petitioner has got no criminal antecedent. On account of some enmity, the petitioner has falsely been implicated in the case. Now the

Patna High Court CR. MISC. No.10891 of 2020(2) dt.02-03-2020 2/2 victim has compromised the case. The petitioner is in jail since 14.11.2019. The petitioner has already remained in jail for more than three and half months.

Having considered the facts and the nature of allegation made against the petitioner and the fact that the petitioner has already remained in jail for more than three and half months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.D.J.-cum-Special Judge, POCSO Act, Bhagalpur in connection with Lodipur P.S. Case No.20 of 2019 (S.P. POCSO-7/19).
