JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-10-2021 Heard the parties through virtual court proceeding. The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
In pursuance to the order dated 27.07.2021, status report of trial in connection with S.T. No. 303 of 2019 arising out of Pirpainty P.S. Case No. 28 of 2017 has been received and kept at Flag-A, in which it is reported that out of twenty one witnesses including informant and investigating officer, the examination of five public witnesses have been done and summon against rest witnesses including informant and investigating officer have been issued on 18.10.2019 but till date no witnesses have been examined.
Considering the present stage of the trial, I am not
Patna High Court CR. MISC. No.18297 of 2021(3) dt.22-10-2021 2/2 inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with S.T. No. 303 of 2019 arising out of Pirpainty P.S. Case No. 28 of 2017 pending before the court of the learned 4th Additional District and Sessions Judge, Bhagalpur.
Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of nine months from the date of initiation of normal physical proceeding and /or through Video Conferencing and S.S.P., Bhagalpur is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
