The petitioner apprehends his arrest in Rajapakar P.S. Case No.106 of 2020, registered for the offence punishable under Section 306 of the Indian Penal Code.

The petitioner is said to have instigated the son of the informant to commit suicide.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is submitted that there is no eye witness of the occurrence. Merely on suspicion, the petitioner is made accused in the case. The petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.18287 of 2021(2) dt.15-12-2021 2/2 anticipatory bail of the petitioners and submits that the petitioner has instigated the deceased to commit suicide. Having considered the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Vaishali at Hajipur in connection with Rajapakar P.S. Case No.106 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
