ANJANA PRAKASH ORAL JUDGMENT Date: 31-03-2016 The petitioner seeks quashing of the order 13.10.2014 passed in B.P. No. 197 of 2014/1175 of 2014 by the learned Adhoc Additional District Judge 2nd Gaya by which he has refused to remove/relax the conditions imposed upon the petitioner by order dated 19.08.2014 in B.P. No. 196 of 2014/1175 of 2014 in connection with Chandauti (Chakand) P.S. Case No. 381 of 2013. It has been submitted on behalf of the petitioner that the admitted position is that the petitioner was in custody since 03.05.2014 and the marriage is not workable.

In view of such, the application is allowed and the conditions imposed by order dated 19.08.2014 in B.P. No. 196 of

Patna High Court Cr.Misc. No.45360 of 2014 dt.31-03-2016 2/2 2014/1175 of 2014 in connection with Chandauti (Chakand) P.S. Case No. 381 of 2013 and the order 13.10.2014 passed in B.P. No. 197 of 2014/1175 of 2014 by the learned Adhoc Additional District Judge 2nd Gaya, are hereby set aside.

However, from now the petitioner shall pay Rs. 1500/- per month instead of Rs. 750/- to the Opposite Party no. 2 in terms of the order dated 20.11.2014 passed by this Court.
