====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Two motorcycle borne unknown criminals fired at the brother of the informant as a result whereof he died on the spot. Allegation is that on a second motorcycle two more persons came, they had also fired. Out of the four, one was apprehended at the spot who disclosed his name as Rajnikant Kumar Singh. In the confessional statement before the police Rajnikant Kumar Singh named another co-accused as assailant of the deceased.

Learned counsel for the informant submits that on one occasion, the petitioner had jumped the bail and fled away from the remand home. Moreover, he has got criminal antecedent and he confessed before the police after arrest.

Considering the fact that there is no substantial material against the petitioner and he is in custody since 15.07.2018, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihar Police Station Case No. 315 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
