JUSTICE AMARESH KUMAR LAL ORAL ORDER 29-01-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is in custody since 06. 07. 2014, in a case registered for the offence punishable under Sections 341, 323, 354, 379, 504 and 34 of Indian Penal Code and under Sections 3(i)(x) of S.C./S.T. Act.

It is submitted that petitioner has been falsely implicated in this case as prior to filing of present case, the petitioner has filed a case bearing Ram Nagar Police Station Case No. 75 of 2014 against the husband of the informant as daughter of the petitioner had been kidnapped by the husband of the informant and case was instituted for offence punishable under Sections 363 and 366A of the Indian Penal Code. It is further submitted that

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bagaha, in connection with Ram Nagar P.S. Case No. 126 of 2014 with the following conditions :

1.

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
