2. The petitioner seeks bail in a case registered for offence under Sections 304(B), 201, 120(B) of the Indian Penal Code.
3. The petitioner is husband of the deceased and is in custody since 03.08.2023.
4. Learned counsel for the petitioner submits that petitioner has been implicated in this case merely because he happens to be husband of the deceased. In fact, the deceased died due to burn injury. In this case, learned Magistrate has taken cognizance on 02.02.2024 under Sections 498(A), 304(B), 201 of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act. No eye-witness has supported the prosecution case.

Learned A.P.P. opposes the prayer for bail and submits that petitioner is husband of the deceased and there is specific allegation of demand of Rs. 2,00,000/-, as dowry, and due to non-fulfillment of the same, the deceased was subjected to cruelty and torture by all the accused persons including this petitioner.
6. However, considering the period of custody, let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - 9, Samastipur in connection with Kalyanpur P.S. Case No. 134 of 2022.
