The petitioner seeks bail in Riga P.S. Case No. 98 of 2012, registered for the offences punishable under Sections 307 and 387 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is named in the FIR, but it appears from the perusal of the fardbeyan of the informant that the informant received call for extortion from mobile no. 8434920716. The informant named Mohan Baitha and Chiranjeevi who demanded extortion. It is alleged that the caller, Chiranjeevi and Mohan Baitha are the men of the petitioner. During the course of investigation, it appears that the investigating officer could not trace out the owner of mobile numbers from which extortion was made.
Patna High Court Cr.Misc. No.45090 of 2014 (4) dt.06-04-2015 2/2 Learned counsel for the petitioner submits that the petitioner has got, of course, criminal antecedent, but he in jail since 17.02.2014 and till date the investigating officer although submitted charge sheet, did not collect no evidence to show the involvement of the petitioner.
Considering the facts aforesaid and the fact that the petitioner is in jail for more than one year in a case in which only suspicion is raised against the petitioner, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S.
