JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in connection with Madanpur P.S. Case No. 267 of 2020 registered for the offence punishable under Sections 341, 323, 504, 506, 307, 324 and 427 of the Indian Penal Code.

As per the prosecution case, allegation against the petitioner is that petitioner abused and assaulated the

Patna High Court CR. MISC. No.18359 of 2021(2) dt.19-07-2021 2/3 informant's aunt and uncle by means of sharp edge sword and other articles as a result of which informant's uncle got several cut injury. He also threatened to kill the informant due to an ongoing land dispute.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case and has not committed any offence as alleged in the FIR. He submits that there is case and counter blast case between the parties, the petitioner himself registered a case vide Madanpur P.S. Cae No. 268/2020 for the offences punishable under Sections 341, 323, 324, 307, 372, 504, 506/34 of the I.P.C. He submits that as per the F.I.R. due to a piece of land there was free fight between the parties and in course of transaction both the parties are injured. He further submits that from perusal of the injury report of the informant and his uncle Babban Singh, it is found that both the injury are simple in nature. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent and has been languishing in custody since 28.11.2020.

Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, on furnishing bail

Patna High Court CR. MISC. No.18359 of 2021(2) dt.19-07-2021 3/3 bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Madanpur P.S. Case No. 267 of 2020.
