The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the four accused persons including the petitioner herein caught hold of the victim, it is stated that Rajesh Choudhary fired killing him. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations against him are general and omnibus in nature. He is in custody since 22.7.2019 and his case stands on a similar footing to that of co-accused Prakash Choudhary who has been enlarged on bail vide order dated 22.12.2016 passed in Cr. Misc. no.49917 of 2016 and Bedanand Chaudhary who has been

The petitioner is in custody since 22.7.2019 and no witness having been examined in the trial court, there is no chance of the trial concluding in the near future. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody since 22.7.2019 and as per the report received from the learned trial court no witness having been produced by the prosecution, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.288 of 2019 (arising out of Parbatta P.S. Case no.147 of 2015) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Fast Track Court II, Khagaria.
