The petitioner seeks bail in connection with Sessions Trial No.237 of 2015, arising out of Amarpur P.S. Case No.91 of 2014 registered under Section 302 of the Indian Penal Code besides Sections 3/4 of the D.P. Act, pending in the court of Additional Sessions Judge-IV, Banka.

The accusation is that this petitioner and the wife of Manoj Kumar Singh, dragged Samo Devi, the mother of the informant, Brahmdeo Prasad Singh, and took her at their house from her house and naked her. Thereafter, this petitioner assaulted her through 'Danda' whereas the wife of Manoj Kumar Singh

Patna High Court Cr.Misc. No.50912 of 2015 (2) dt.18-12-2015 2/2 assaulted her through fists and slaps as a result of which she died. Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant him bail. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
