The petitioner wants to renew his prayer of pre- arrest bail, which was earlier rejected vide order dated 20.01.2015 passed in Cr. Misc. No. 30343 of 2014, on the ground that now the matter has been compromised between the parties and there was no intention to commit murder so section 307 of Indian Penal Code is not made out, to which the learned A.P.P. opposes whereas the learned counsel for the informant does not oppose the prayer of pre-arrest bail.

In the facts and circumstances stated above, finding that it is second attempt for pre-arrest bail and as such, I am not

No.11454 of 2016 (3) dt.31-08-2016 2/2 inclined to re-consider the prayer of pre-arrest bail, again the prayer for pre-arrest bail of the petitioner stands rejected in connection with Ladania P.S. Case No. 145 of 2013 pending in the court of learned C.J.M., Madhubani, if so advised the petitioner surrenders within four weeks from the date of receipt/production of a copy of this order, his prayer for regular bail shall be considered on the ground that mater has been compromised between the parties preferably on the same date itself.
