Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Harnaut (Telmar) P.S. Case No. 127 of 2022 dated 18.03.2022 lodged under Sections 304B and 34 of the I.P.C. As per the prosecution case, the F.I.R. has been lodged for dowry death under Section 304B & 34 of the I.P.C. against the husband and other family members. Learned counsel for the petitioners submits that petitioners of the present case are mother-in-law and father-inlaw of the deceased. Counsel submits that they are old aged persons and there is nothing specific against them, only general and omnibus allegation are there.

Patna High Court CR. MISC. No.9017 of 2023(2) dt.03-05-2023 2/2 Counsel submits that antecedent of the petitioners are clean and they are in custody since 17.10.2022. He also submits that the husband of the deceased is already in custody and there is every likelihood that trial shall commenced soon. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Harnaut (Telmar) P.S. Case No. 127 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
