ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 12.5.2014 in connection with Durgawati P.S. Case No.69 of 2014 registered for the offences under Sections 395 and 397 of the Indian Penal Code. It is submitted on behalf of the petitioner that apart from the confessional statement made by this petitioner before the police, which is inadmissible in evidence, there is no cogent material on record so as to connect the petitioner with the present case. It is further submitted that the petitioner was implicated in one another case, in which he has already been granted bail and it is only on account of hindrance created in the said case, that the present case has been lodged against him.

No.46393 of 2014 (3) dt.16-02-2015 2/2 Considering the aforementioned submissions and also the fact that the petitioner has been in custody since 12.5.2014, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S. Case No.69 of 2014.
