1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Murliganj P.S. Case no.505/2022 registered under sections 18, 20 and 22 of the N.D.P.S Act.

3. As per the prosecution case, two accused persons on a motorcycle on being checked were apprehended with Ganja. While 350 gms of Ganja was recovered from the petitioner's possession, 550 gms was recovered from possession of the co-accused.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely in the case and has no criminal antecedent. The petitioner is in custody since 5.12.2022

Patna High Court CR. MISC. No.10231 of 2023(2) dt.10-05-2023 2/2 and charge-sheet has been submitted in the case.

5. Heard learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the FIR according to which 350 gms of Ganja was recovered from the petitioner's possession, the petitioner not having any criminal antecedent, his being in custody for more than 5 months since 5.12.2022 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Murliganj P.S. Case no.505/2022, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge -cum- Special Judge N.D.P.S Act, Madhepura.
