The petitioners are languishing in custody since 08.10.2018 in a case registered for the offences punishable under Sections 413 and 414 of the IPC.

The prosecution case, as per the self statement of SI, Sanjeev Kumar, SHO, Sahiyara Police Station is to the effect that on 06.10.2018 in course of patrolling, three persons were intercepted moving on a motorcycle who disclosed their names as Sudhir Kumar, petitioner no.1, Ranjeet Kumar, petitioner no.2 and co-accused Dhirendra Sahni. Thereafter, during investigation, it transpired that the intercepted motorcycle was stolen, leading to registration of FIR against the petitioners and co-

It is submitted by learned counsel for the petitioners that the petitioners were simply the pillion rider. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP submits that the stolen motorcycle was recovered from the possession of the petitioners. Considering the fact that recovery being made from three persons including the petitioners, the investigation has already been concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Sahiyara P.S. Case No.171 of 2018.
