Petitioner apprehends his arrest in a case registered under Sections 279, 337, 338 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. Allegation is recovery of 14.70 lites of foreign liquor from the bag which was kept on motorcycle.

It has been submitted on behalf of the petitioner that petitioner is not named in the FIR. Petitioner is owner of said motorcycle has been framed in this case, when he had to flee away leaving the motorcycle on the road due to motorcycle accident and nearby villagers assembled and became aggressive. Considering the facts and circumstances of the case,

Patna High Court CR. MISC. No.7762 of 2020(2) dt.28-02-2020 2/2 prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Mahua P.S. Case No. 483 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
