JUSTICE MUNGESHWAR SAHOO ORAL ORDER 04-02-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, namely, Domi Yadav, who is in custody since 28.08.2014 in connection with Beldaur P.S. Case No.152 of 2014 under Section 392 and 411 I.P.C.

According to the prosecution case, four unknown persons looted the clothes from the cycle of the informant. The learned counsel for the petitioner submitted that subsequently, the petitioner has been made accused in this case and the informant forcibly identified the petitioner in T.I. parade. So far recovery of cross material are concerned, the same has been recovered from bomboo cluster and not from the possession of the petitioner.

No.45621 of 2014 (2) dt.04-02-2015 2 / 2 Considering the nature of allegation and the period of detention, I direct the petitioner, above named, be released on bail on furnishing bail bond of Rs.5,000/- (rupees five thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Khagaria in connection with Beldaur P.S.
