The petitioner is languishing in custody since 20.11.2018 in a case registered for the offence punishable under Sections 413/414/34 of the Indian Penal Code. It is alleged that from the house of the petitioner, one stolen black-blue coloured Glamour Motorcycle was recovered.

It is submitted by learned counsel for the petitioner that the petitioner purchased the said motorcycle from one Lalan Sahni prior to lodging of the present case. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP for the State submits that the stolen

Patna High Court Cr.Misc. No.7709 of 2019(2) dt.11-02-2019 2/2 motorcycle has been recovered from the possession of the petitioner.

Considering the period of custody, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XIVcum-ACJM-XIII, Muzaffarpur in connection with Aurai (Muzaffarpur) P.S. Case No.264 of 2018.
