The petitioner seeks bail in a case registered for the offence under Sections 363, 366(A), 376(G) of the Indian Penal Code and Sections 4 / 8 of the POCSO Act.

It is submitted on behalf of petitioner that though, petitioner is named in the F.I.R., but in the statement recorded under Section 164 Cr.P.C., the victim girl has not alleged any sexual assault against this petitioner. Specific allegation of commission of rape is against other co-accused persons and so far as this petitioner is concerned, she has stated that this petitioner had also come there on his motorcycle. Petitioner has got clean antecedent and he is in custody since 23.12.2021. Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Muzaffarpur in connection with Paroo P.S. Case No. 365 of 2019.
