The petitioner is languishing in custody since 22.09.2018 in a case registered for the offences punishable under Sections 392 and 412 of the Indian Penal Code. The prosecution case is that the petitioner along with two other co-accused persons, snatched the motorcycle of the informant. On chase being made, two co-accused persons were apprehended from the spot and one accused person managed to escape from the scene. The apprehended co-accused persons disclosed their names as Jitendra Kumar, co-accused and Manish Kumar, the petitioner.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.8700 of 2019(2) dt.15-02-2019 2/2 that nothing has been recovered from the possession of the petitioner and only on the basis of suspicion the accusation has been levelled against the petitioner. It is further submitted that the investigation has already been concluded. Learned APP for the State submits that the petitioner was named in the FIR and he was caught on the spot. Considering the period under custody and fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st A.C.J.M., Chapra, in connection with Sonepur P.S.
