Accordingly, present MJC No. 399 of 2019 stands dropped reserving liberty to the petitioner in the event of misleading this Court by the concerned opposite party Nos. 2 to 5 to the extent that physical encroachment has been removed is incorrect, in that event, necessary interlocutory application shall be filed to recall the present order for restoration of MJC No. 399 of 2019.
