JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-04-2018 Petitioner has a grievance with the Superintendent of Police, Naugachia (respondent no.5) who is said to have orally withdrawn the security guards provided to the petitioner by virtue of the decision taken by the District Level Security Committee in its meeting held on 20.07.2017. He has also brought on record a copy of the letter, as contained in memo no.1003 dated 04.03.2018, issued under the signature of respondent no.5, by which he has been able to demonstrate that certain criminals are roaming at large and this petitioner has got threat to his life

Patna High Court Cr. WJC No.1066 of 2018 (2) dt.25-04-2018 because he has been requesting to the demand of money by those miscreants. Learned counsel representing the petitioner has drawn the attention of this Court towards the last paragraph of the letter, as contained in Annexure-6, from which it appears that the request of the petitioner for providing security guards is under consideration and the same is to be decided in the light of the Resolution No.3663 dated 02.05.2017 issued by the Home Department (Special Branch), Bihar.

No one appears to represent the State of Bihar. In the nature of the submissions, which have been advanced before this Court, as there is no counter affidavit controverting the submissions of the petitioner, this Court would direct the Superintendent of Police, Naugachia to ensure safety and security of this petitioner from any miscreants or criminals and he shall ensure that the directions given by him to the officer in-charge of the concerned police station to arrest the criminals be complied with at the earliest if they are not on bail and in case the application of the petitioner is still pending to be considered by the State Level Security Committee, the Superintendent of Police, Naugachia will send his report to the State Level Security Committee who is empowered to consider the request for providing security guards and on such submission of the report

Patna High Court Cr. WJC No.1066 of 2018 (2) dt.25-04-2018 within a period of four weeks from today, the State Level Security Committee shall consider the application of the petitioner in accordance with the norms and guidelines as per the policy decision of the government. In any case the entire exercise must be completed within a period of three months from today. The writ application stands disposed off with the aforesaid directions.
