The petitioner seeks bail in a case under Sections 302 and 120(B)/34 of the Indian Penal Code as well as Section 27 of the Arms Act.
The informant is not an eye witness of the occurrence. The informant alleged that his father Awadheswar Prasad Singh was lying in an injured condition by the side of the road. The informant further alleged that he came to know from reliable sources that his father was moving around with one Mickky Kumar and petitioner is the uncle of Mickky Kumar. The petitioner and the father of the informant were good friends and father of the informant had given money to him but petitioner did not return the same.
Patna High Court Cr.Misc. No.45117 of 2014 (2) dt.23-02-2015 It is submitted that the petitioner was not even seen moving around the deceased. Mickky Kumar who is alleged to have been moving around with the deceased just before the occurrence has already been enlarged on bail vide order passed in Cr. Misc. No. 16 of 2015.
Considering the fact that except suspicion, there is no material against the petitioner, petitioner, namely, Alok Kumar Singh is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 124 of 2014.
