ANJANA MISHRA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with POSCO 28/2014 arising out of Saharsa Sadar P.S. Case No.843 of 2014 registered for the offence under Sections 366A/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is named in the F.I.R., yet the victim girl in her statement under Section 164 Cr.P.C. has not made any allegation against him. He further submits that the petitioner is not having any criminal antecedent save and except one case under the Excise Act.
Considering the fact that the petitioner is not named
Patna High Court Cr.Misc. No.51003 of 2016 (3) dt.11-01-2017 2/2 by the victim girl in her statement under Section 164 Cr.P.C., let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions-Cum-Special Judge, Saharsa, in connection with Saharsa Sadar P.S. Case No.843 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
