The petitioner seeks bail in anticipation of his arrest in connection with Sitamarhi P.S. Case No. 249 of 2019 dated 27.04.2019 (G.R. No. 1719 of 2019) instituted for the offences under Sections 341, 342, 323, 324, 307, 379/34 of the Indian Penal Code.

The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 20.08.2019 in Cr. Misc. No. 51772 of 2019.

It has been submitted on behalf of the petitioner that after the rejection of the anticipatory bail of the petitioner as referred to above, another accused person with similar allegation has been granted anticipatory bail by a different

Patna High Court CR. MISC. No.18622 of 2021(2) dt.11-03-2022 2/2 Bench of this Court vide order dated 14.02.2020 passed in Cr. Misc. No. 87191 of 2019.

This Court is afraid, that cannot be a ground for reconsideration of the grant of anticipatory bail which has once been rejected by a co-ordinate Bench of this Court. I am not inclined to granted anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected. Should the petitioner surrender before the court below and seek bail, the court below shall consider the same on its own merit, taking into account that another accused person of this case has been granted anticipatory bail and shall pass order in accordance with law without being prejudiced by the fact that the present application has not been entertained by this Court.
