2. The petitioner seeks bail in connection with NDPS No. 8 of 2024 arising out of Gidhaur P.S. Case No. 72 of 2024 instituted for the offence under Sections 411, 412, 414, 467, 467, 468, 471/34 of the Indian Penal Code, under Sections 25(1-B)a, 26/35 of the Arms Act and under Sections 8/20(B)(II) of the NDPS Act.

3. As per the prosecution case, the recovery is of 1 Kg 90 grams of Ganja, one automatic country made pistol, three live cartridges from the accused persons.

4. It has been submitted by the learned counsel for the petitioner that the recovery is not made from the petitioner and the petitioner is in custody since 9.9.2024. The name of the petitioner has come in the confessional statement of the coaccused.

5. Considering the aforesaid facts, this application

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Jamui/concerned Court below in connection with NDPS No. 8 of 2024 arising out of Gidhaur P.S. Case No. 72 of 2024, subject to the condition that both the bailors should be the close relative of the petitioner.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Gidhaur Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
