JUSTICE SHIVAJI PANDEY ORAL ORDER 04-02-2015 Heard learned counsel for the petitioners and the State. The petitioners are seeking bail in Narkatiaganj Rail P.S. Case No. 27 of 2014 registered for the offence punishable under Section 414/34 of the Indian Penal Code. The allegation has been made that the petitioners were going along with huge quantity of silver, which were being transported from Nepal.

Learned counsel for the petitioners states that they are the employees of Gopal Prasad, who carries the business of silver and gold. He further submits that 41 kilo 450 grams of silver was

No.45925 of 2014 (2) dt.04-02-2015 2/2 being transported to Gorakhpur but on conspiracy the employees were apprehended and seizure has been effected showing lesser amount of silver, for that Gopal Prasad has filed a petition before the Superintendent of Police, Rail Police, Muzaffarpur stating that the policy party committed theft of 28 kilo 166 grams of silver. In the aforesaid facts and circumstances of the case, let above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bettiah , West Champaran, in Narkatiaganj Rail P.S.Case no.27/2014.
