JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State as well as informant. The petitioner is in custody in connection with Mohania P.S. Case No. 656 of 2018 for the offence under Section 498A, 379, 313, 34 of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that petitioner is father-in-law of the informant of this case. Learned counsel for the petitioner would submit there is omnibus allegation against this petitioner and petitioner is in custody since 07.01.2019.

Considering the fact that petitioner has no criminal
