2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 325, 307, 120B/379 of the Indian Penal Code.
3. As per the prosecution case, on the alleged date and time of the occurrence, all the FIR named accused persons including this petitioner brutally assaulted the informant with iron rod and hockey stick due to which informant and his friend sustained multiple injuries.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Allegation of assault is general and omnibus against this petitioner and no specific overt act has been alleged against him. Several Co-accused, with similar
Patna High Court CR. MISC. No.9692 of 2025(2) dt.15-05-2025 2/2 allegation, has already been allowed pre-arrest bail by a coordinate bench of this Court vide order passed in Cr.Mis.No.87178/2024 ( annexure P/3). Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Saran at Chapra in Garkha Police Station Case No. 382 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
