====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 06-11-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Madhepura (Parmanandpur O.P.) P.S. Case No.82 of 2013 registered under Sections 341, 323, 447, 427, 384, 504 and 506/34 of the Indian Penal Code.

The accusation is that the petitioner alongwith other F.I.R. named accused armed with deadly weapons entered into the wine shop of the informant and made demand of Rs.50,000/- from him as ransom. On refusal, they abused and assaulted the informant with fists and slaps and also broken and destroyed the wine-bottles of the shop of the informant.

Patna High Court Cr.Misc. No.48115 of 2015 (2) dt.06-11-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case with an ulterior motive. Further submission is that the other coaccused have already been granted bail by the court below while the prayer of the petitioner for bail was rejected by the court below through the impugned order on the ground of his involvement in four other cases as detailed in paragraph-3 to this application. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Madhepura (Parmanandpur O.P.) P.S. Case No.82 of 2013. Out of the two sureties, one must be close relative of the petitioner, who shall file an affidavit giving genealogy as to how he/she is related with the petitioner.
