JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 21.03.2015 in connection with Gaurichak P.S. Case No. 39 of 2015 for the offences instituted under Section 364/34 of the IPC. The prosecution story, in brief, is that on 04.03.2015 at about 9.15 P.M., when the informant was coming to his house from his egg shop alongwith his son, two unknown persons intercepted them and on the point of pistol, they lifted the informant's son aged about 8 years and fled away with him, informant's son was in blue jeans and white T.Shirt. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in
Patna High Court Cr.Misc. No.35210 of 2015 (3) dt.05-10-2015 2/2 custody since 21.03.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence. The petitioner is not named in the FIR nor the victim has named this petitioner in 164 Cr. P.C. statement. The name of the petitioner has come on the basis of confessional statement of coaccused. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Patna City, Patna, in connection with Gaurichak P.S. Case No. 39 of 2015.
