2. The petitioner apprehends his arrest in connection with Chhatauni P.S. Case No. 315 of 2023, registered for the offences punishable under Sections 147, 148, 341, 384, 504, 506 of the Indian Penal Code and 25(1-b), 27 of the Arms Act.
3. As per allegation, on 27.06.2023 at about 8 P.M., the accused persons including the petitioner came at the door of the informant and started abusing and firing. The accused persons demanded rupees five lakh as extortion money and threatened him to kill if not given.
4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated. Though, there is allegation of firing but none has suffered any kind of injury. The
Patna High Court CR. MISC. No.8439 of 2025(2) dt.21-02-2025 2/2 FIR has been lodged after nine days of the occurrence which itself falsifies the allegation. He has furthers submitted that on similar footing, co-accused Ravi @ Ravi thakur @ Golu Thakur and co-accused Suraj Kumar @ Suraj Thakur have been granted bail by this Court.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrenders within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chhatauni P.S. Case No. 315 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
