2. The petitioner seeks regular bail in connection with Mehsi P.S. Case No. 127 of 2024 lodged on 17.08.2024, for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. Learned Counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 06.12.2024 passed in Cr. Misc. No. 76039 of 2024 with liberty granted to the petitioner to renew his prayer for bail after framing of charge. Counsel submits that the charge has been framed in this case on 04.01.2025 and petitioner is in custody since 07.09.2024. Counsel further submits that on

Learned APP for the State opposes the prayer for bail of the petitioner and submits that charge has been framed in this case and on earlier occasion, report with regard to the present stage of the trial has been called for and from the said report, it transpires that out of nine charge-sheet witnesses, four witnesses are examined. Counsel further submits that the criminal antecedent of the petitioner is not clean as there are five cases pending against him.

In the present facts and circumstances of this case, let the petitioner above named, be granted bail as well as on being satisfied by the Trial Court that the petitioner is not absconding in any of the cases pending against him whose details are mentioned below, and on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No.3, Motihari, East Champaran in connection with Mehsi P.S. Case No. 127 of 2024, subject to the conditions as laid down U/s 437(3) Cr.P.C.
