The petitioner is in custody since 12.08.2014 in a case for the offence registered under Section 379 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the name of the petitioner has surfaced during the course of investigation on the basis of the confessional statement of one Chamru Yadav @ Uttam Yadav, who was arrested on 12.08.2014 . It is further submitted that save and except the confessional statement made by the aforesaid Chamru Yadav @ Uttam Yadav, there is no other cogent material so as to connect the petitioner with the present case. It is further submitted that petitioner has no criminal antecedents and for no fault of his own merely on the basis of the confessional

Patna High Court Cr.Misc. No.45150 of 2014 (3) dt.04-03-2015 statement which is inadmissible in evidence the petitioner is languishing in jail since 12.08.2014.

Considering the aforesaid submissions, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 512 of 2014.
