The petitioner seeks regular bail in a case under sections 302 and 201/34 of the Indian Penal Code. The wife of the deceased made an allegation that the petitioner called Idris Mian, the husband of the informant and saw that the petitioner and others were talking with the petitioner outside the house of the informant. They all went away to take liquor. On the next day in the morning the informant knew about the dead body of her husband.
It is submitted that thee is absolutely no evidence against the petitioner. The petitioner has got no motive. The informant herself alleged that her husband was a drunkard. No body has seen the occurrence. The petitioner is in jail since
Patna High Court Cr.Misc. No.45308 of 2014 (2) dt.04-03-2015 13.05.2014.
Considering the fact that there is no eye witness of the occurrence and the petitioner is in jail since 13.05.2014, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Barachatti (Mohanpur) P.S. case No.116 of 2014.
