JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 22.04.2015 in connection with Buxar(T)P.S. Case No. 167 of 2015 for the offences instituted under Sections 25(1B)(A), 26(2) and 35 of the Arms Act.

The prosecution story, in brief, is that the informant Police Officer during morning patrolling, found two persons trying to lee away near the Railway Hospital but were apprehended and they disclosed their names who are the petitioner and Ravi Singh but did not disclose the reason of fleeing and they in presence of two independent witnesses search was made in which one country made loaded Katta was recovered from co-accused Ravi Singh and

No.35342 of 2015 (3) dt.05-10-2015 2/2 from the waist another petitioner Chunnu Singh one country made pistol was recovered which description are also mentioned in the F.I.R. and when asked about license, they did not produce and then the seizure list was prepared and apprehended persons were arrested and case was lodged.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.04.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence. As per allegation, one country made pistol and one cartridge is said to have been recovered from possession of the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, in connection with Buxar(T) P.S.
