JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 26.06.2015 in connection with Silao P.S. Case No. 23 of 2015 for the offences instituted under Section 392 of the IPC.
The prosecution story, in brief, is that while the informant was returning on vehicle from the village, two or three persons got the vehicle stopped and began to assault him and took away two mobiles with SIM from his pocket. After some time seeing some vehicles coming they fled away and due to that the informant was saved from further assault and loot. The age of the miscreants was 25 to 30 years and their faces were covered with
Patna High Court Cr.Misc. No.35355 of 2015 (3) dt.05-10-2015 2/2 clothes. They were of Sawala and black complexion and speaking local language.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 26.06.2015. The petitioner is not named in the F.I.R. nor he has been put on T.I. Parade. It has further been submitted that the petitioner may be released after completion of seven months in custody from 26.06.2015.
On behalf of the State it has been submitted that the name of the petitioner has come in course of investigation on the basis of confessional statement of co-accused.
Considering the aforesaid facts and circumstances, it is directed that the petitioner may be released on bail after completion of seven months in custody from 26.06.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharshariff in connection with Silao P.S. Case No. 23 of 2015.
