On account of misappropriation of the amount by the accused persons depriving the real beneficiaries led initiation of an inquiry and on the basis of the inquiry report instant case has been registered. So far petitioner is concerned, during investigation it transpired that he impersonated his brother and obtained Rs.35,000/- in lieu of Indira Awas Yojna on account of identification having been at the end of Mukhiya as well as Panchayat Secretary.

It has been submitted on behalf of petitioner that his brother has not complained. Furthermore, the Mukhiya and the Panchayat Sewak have already been granted bail vide Cr. Misc. No.28758 of 2012, 12286 of 2012 respectively.

Patna High Court Cr.Misc. No.48010 of 2014 (3) dt.03-04-2015 To maintain parity in the order, let petitioner Mofiz is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Sirdala P.S. Case No.144 of 2011.
