The petitioner seeks bail in Jokihat P.S. Case No. 292 of 2014, registered for the offences punishable under Sections 409, 420 and 120B of the Indian Penal Code.

The petitioner was entrusted to execute scheme nos. 51, 54 and 57 of 2010 -2011 and for that the petitioner got Rs. 3,75,000/- for execution of work of the three schemes. Learned counsel for the petitioner submits that from perusal of para-46, the report of the B.D.O., it would appear that the petitioner earlier given Rs. 25,000/- as advance and he purchased construction materials and kept the same on construction site in the month of June, but the petitioner thereafter in the first week of July was transferred therefore

Patna High Court Cr.Misc. No.46057 of 2014 (5) dt.21-04-2015 2/2 he could not execute the three works entrusted to him. It is further submitted that the petitioner is ready to deposit the remaining amount that is Rs. 3,00,000/- within four months in three installments.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 292 of 2014, subject to the condition that the petitioner shall deposit the entire amount of Rs. 3,00,000/- within four months from the date of his release in three equal installments and if the petitioner fails to deposit the aforesaid amount, the court below shall cancel the bail bond of the petitioner.
