Learned counsel for the petitioner has made a limited prayer that the appeal filed by the petitioner, against the order dated 4.5.2013 of the S.D.O. Sadar, Purnea, cancelling the licence of the petitioner, is pending for final adjudication before the Collector, Purnea, may be directed to be disposed of. It appears that for violation of Essential Commodities Act the petitioner has faced three proceedings, one is for the criminal case, another for confiscation proceeding and the third is for cancellation of licence. The present case is confined to cancellation of licence, which has been passed by the SDO,

Patna High Court CWJC No.2152 of 2017 (3) dt.15-03-2017 2/2 Purnea, and against which an appeal is pending before the Collector, Purnea, whereas in the confiscation proceeding order passed by the Collector in Confiscation Appeal No.2 of 2014 has been set aside by the Sessions Judge, Purnea. In such view of the matter, the Collector, Purnea is directed to dispose of the appeal filed by the petitioner within a period of two months from the date of receipt/production of a copy of this order.

With the above observations and directions, this application is disposed of.
