JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 The petitioner seeks regular bail in connection with Bheja P.S. Case No. 108 of 2019, registered for offences punishable under Section 379 of the Indian Penal Code. Allegation is of commission of theft of scorpio vehicle of the informant, petitioner is not named in the F.I.R., his name transpired during course of investigation and apart from that petitioner is accused in two more cases.
It has been submitted on behalf of the petitioner that while he was travelling with other accused person on motorcycle, they were arrested and it was alleged that the motorcycle was stolen one and, thereafter, on confession of other accused person, the name of petitioner surfaced in the present case. It has also been submitted that he has falsely been implicated in this case and there is no recovery from the
Patna High Court CR. MISC. No.6921 of 2020(2) dt.06-02-2020 2/2 petitioner and he has been in judicial custody since 26.9.2019. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -II, Jhanjharpur, Madhubani, in connection with Bheja P.S. Case No. 108 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
