The petitioners seek bail in a case registered under Sections 147, 323, 354, 379, 452, 313 and 504 of the Indian Penal Code.

It is contended that though the occurrence has been shown to be of 17.03.2015 but the complaint was lodged by the complainant on 06.04.2015 i.e., after about 20 days alleging that the petitioner and others had come to forcibly

The matter was sent for investigation under Section 156(3) of the Cr.P.C. by the Police on which the first information report was lodged. It is further contended on behalf of the petitioners that today a charge-sheet has been submitted also showing the petitioner as an accused. It is urged that it is a fact that the petitioners have purchased the premises, however, they were only trying to impress upon the complainant/informant and his family for not putting their residential address showing the said premises in the Adhar Card on which alleged altercation took place. Learned counsel for the petitioner undertakes on instruction that the complainant and his family would never be forcibly evicted by using unlawful means from the house concerned and if they are required to be evicted then the petitioner would take recourse of a legal proceeding.

Having regard to the facts and the circumstances of the case, the petitioners, Hare Ram Chauhan and Basant Chauhan are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Smt.
