JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-06-2019 Petitioner, in the present case, is seeking a direction to the respondents to consider her case for grant of Public Distribution Shop licence in the general category (female) for ward no.10, Block-Nagar Parishad, District-Lakhisarai. It is the case of the petitioner that pursuant to advertisement for appointment of Public Distribution Shop Dealer in the all the category in the different Panchayat Block and sub-division of the District Lakhisarai the petitioner being a general category (female) candidate made an application. On 15.12.2018, the District Selection Committee held its meeting. The name of the petitioner was though incorporated in the provisional merit list which was published on 16.07.2018, but at

Patna High Court CWJC No.2741 of 2019(2) dt.18-06-2019 2/3 the time of final selection the case of the petitioner was not considered for the reasons not known to the petitioner. It is submitted that the Collector, Lakhisarai should have appointed the petitioner as PDS Dealer because there was none-else than the petitioner for the said vacancy in ward no.10 of the Nagar Parishad, Lakhisarai.

Learned counsel for the State is present. It is submitted that, in the given facts and circumstances of the case, the Collector-cum-District Magistrate, Lakhisarai may be directed to look into the grievance of the petitioner, examine the same and take an appropriate decision thereon in accordance with law.

Having heard learned counsel for the parties, this Court is of the considered opinion that at this stage without going into the merit of the contentions of the petitioner, this writ application may be disposed off with a direction to the Collector-cum-District Magistrate, Lakhisarai to look into the grievance of the petitioner, consider the same and take an appropriate decision thereon if the vacancy for the said place is still vacant for consideration within a period of 60 days from the date of receipt/production of a copy of this order. This Court directs accordingly to the Collector-cum-District Magistrate,
